When hiring a CEO for the hospital, it is imperative that the boardââ¬â¢s selection process contains depth. To add additional depth to Mr. Bainââ¬â¢s selection process, I will submit to the board that we should implement additional screening measures. First, thorough reference checks would augment the boardââ¬â¢s efforts towards determining if Mr. Bain is the ideal CEO candidate for the hospital. Law (International Business) Essay Example | Topics and Well Written Essays - 2500 words
Law (International Business) - Essay Example To answer the legal questions at hand, let us look into the different principles of law involved in this case. b. Legal Principles Before we can determine as to whether or not there was a passing of property between the seller and the buyer, we need to establish first the existence of the contract. According to Section 3 of the Sale of Goods Act 1895, a contract of sale can be ââ¬Å"made in writingâ⬠¦. or by word of mount, or partly in writing and partly by word of mouthâ⬠¦Ã¢â¬ There are three important elements needed to make a valid contract, namely, a valid cause or object offered, acceptance of the offer and consider. According to the court in the case of Grainger & Sons v Gough1, an offer must be made with the intention of entering into contract with the buyer and not merely an invitation to treat. When it comes to acceptance of the offer, the court ruled in the case of Entores Ltd v Miles Far East Corporation2 the acceptance must be communicated to the seller in ord er for the acceptance to be bidding upon the seller. The acceptance of the offer may be made in writing or through word of mouth. According to Denning LJ in this case, the acceptance must be made unequivocally and such unequivocal acceptance must be communicated clearly to the seller. For instance, if the acceptance was made through telephone, the buyer should see to it that the seller heard the acceptance. Acceptance and counter offer are two different things so it is important to determine as to whether or not what was communicated to the seller is an acceptance of the offer or merely a counter-offer. Note that acceptance give rise to a contract while a counter-offer does not. Also, in acceptance, the buyer accedes to the terms of the seller while in counter-offer; the buyer proposes different terms to the seller. When a counter-offer is accepted by the seller, such acceptance will be binding upon the parties. In international transactions, the place of acceptance is very importan t as this will determine the law applicable to the contract. In the case of Entores Ltd v Miles Far East Corporation3, the court ruled that the place of acceptance is the place where such acceptance is communicated. This means that if the offer was made in UK and the acceptance was made in Australia, the laws of Australia shall govern the transaction since the acceptance of the offer was made in Australia. Acceptance is not absolute in the sense that the parties can revoke the acceptance when the terms agreed upon are not met. According to the court in the case of Grainger & Sons v Gough4, the buyer may withdraw his or her acceptance anytime before or after the contract has been perfected. If the buyer withdraws his or her acceptance before the contract has been perfected, there contract is deemed inexistent. An accepted offer needs to be accompanied by valuable consideration in order for a valid contract to materialize. According to the court in the case of Currie v Misa5, consider ation is not limited to money but also include rights, interest, profits and the like. As stated by the court in the case of Dunlop Pneumatic Tyre Co v Selfridge & Co Ltd6, the valuable consideration can be a ââ¬Å"benefit to the promisor or a detriment to the promiseeâ⬠. Follow the instruction in the details, i will attach the article that you are discussing - Assignment Example The reference chosen was: Doriott, C. (2000). Genetic Codes Unraveled: New Clues to Human History. Ancestry, 18(1), 15 ââ¬â 21(Stix, 2008). The information presented in the article is very contradicting. The reason for this is because; the various biological concepts written on human ancestry discuss the process of evolution from a common ancestor. They do not mention any the point on ââ¬Å"Mitochondrial Eve,â⬠(Stix, 2008). This article increased knowledge about DNA in the mentioning of genetic prospecting which involves researching deeper into the human DNA to find more about their origin. The processes involved including gene slicing. It also aided in understanding of single neucliotide polymorphsisms. The article stated that they help in evaluating the identities of individual populations (Stix, 2008). The most interesting thing in the article was on the dueling theories that states humans migrated from Africa 50 to 60,000 years ago. This beats the understanding of civilization, the age of the universe and theories that try to explain the origin of man, such as that of evolution by Charles Darwin (Stix,

Battle of Little Bighorn - Essay Example oldiers lost during the battle to the Lakota Indians their defeat ironically was a win as it strengthened Americaââ¬â¢s nation building (Calloway, 2012). The changing images show who was either the victim or the victor of the ââ¬Å"battle of the little bighornâ⬠between the Lakota Indians and the American Soldiers at different times. Through the interpretations; the image, ââ¬Å"Custerââ¬â¢s Last Standâ⬠the Indians are depicted as victors, the image of ââ¬Å"they died with their boots onâ⬠depicts the American Soldiers as the victims. On the other hand, in ââ¬Å"little big manâ⬠, it can be interpreted that the victors are Clusters and the American soldiers; in the image ââ¬Å"Lakotas Fighting Custerââ¬â¢s Commandâ⬠, the Indians are the victors while in the image of ââ¬Å"Custerââ¬â¢s Dead Cavalryâ⬠depicts how the American Soldiers were defeated (Calloway, 2012). The Americans and the Indians have portrayed the battle in different forms. The American images depict the Americans as the victors while the Lakota images depict the Indians as the Victors. The American images show General Cluster as the last man standing this is a clear indication that the Americans won the battle. However, the Lakota images depict the Indians as the victors, and they show many dead soldiers (Calloway,

Court Observation Essay Example | Topics and Well Written Essays - 1250 words
Court Observation - Essay Example In the year 1978, five boys were reported missing and were presumed dead. The suspects that were captured at the time, Lee Evans and his cousin, Philander Hampton could not be held due to the absence of credible evidence. However, as time went by, the court found something to link Lee with the murders of the five teens. The issue that arose during the case was the linking of Lee to all the murders (Henry, p. 20). Questions as to why he would do such an act were asked. The public was very interested in the closure of the case. To this day, the bodies of the teens have not been recovered. Families of the deceased are appealing to the accused to disclose the location of the bodies. This is to allow them to be at peace and have the ability to let go of the memory of their lost ones. Facts reveal that Lee Evans and his cousin led the teens into a vacant house, put them in a closet, poured gasoline and lit it. They then left. It is believed that the teens were forced to the abandoned house at gun point (Henry, p. 22). First, three were taken by Lee then two followed later. When asked the reason he was doing this by his cousin, Lee said it was payback since the boys had stolen his marijuana. The case came to a close as the jury found Philander Hampton guilty of the five counts of murder. This is because he had pleaded guilty to the charges. The case had gone cold and had been put under missing persons. A confession from Hampton helped law enforcement agencies to start the case again. This time they had a witness. Lee Evans still has not pleaded guilty to these charges (Henry, p. 23). There was a plea made by Leeââ¬â¢s defence for a mistrial but the judge, Patricia Costello, denied the motion for the mistrial. If the case was considered a mistrial, then the case would have to start all over again. Beside Hampton, Lee Evans is the only other person who truly knows what happened. This means that the prosecution is heavily reliant on his account of what happened. Since the fire destroyed the credible evidence, the prosecutors have nothing else to go by. Leeââ¬â¢s defence asked the witness why he did not stop the accused from doing what he allegedly did. The answer Hampton gave was that he did not know Lee was going to do it (Henry, 25). He is the one who allegedly gave Lee the matches to use to set the place on fire. The prosecution in this case has a hard time since the evidence produced by their only witness is being questioned. With his tenth grade education, Hampton seemed confused with the account of what actually happened. Hampton, in his testimony, claims he fled from the scene of the crime before it was set on fire. He explained to the jurors in the case how the accused, Lee Evans, led the victims into the deserted building and carried out the actions (Millman, p. 15). Lee acted as his own defence at the beginning but later on, he decided to involve a public defender. The credibility of the key witness was also questioned. This was bec ause of his past criminal record. He had been arrested on several occasions and charged with drug possession. He was also charged with shoplifting. The defence thinks that Hampton was coerced into agreeing to testify against his cousin. They also think that if he is the key witness, why did he have to wait this long to decide to testify (Millman, p. 25). As a witness, Hampton had a lot on his plate. Family members claim that they suspected Lee Evans from the start. This is because, at the time of the

Business Ethics, Ethic Dilemma, Manual of conduct Essay
Business Ethics, Ethic Dilemma, Manual of conduct - Essay Example The conflict mainly occurs when dubious decisions are made within an organization and these decisions can lead to major disputes that might even demand legal resolution. Therefore, the ethical requirements that organizations must abide by should be properly and clearly defined to give business owners the opportunity to properly follow them and avoid any legal repercussions that may otherwise result. Put simply, the ethical decision making process is therefore a set of well-established procedures within any given organization that helps in evaluating the best course of action among several options, while working within the ethical requirements of the industry in question.Ã For our research into ethics we have chosen Chiquita Brands. Chiquita Brands has, in the past, embarked upon ethically questionable actions that we have chosen for our case study dilemmas. These dilemmas include the child labor that Chiquita employs on their banana plantations in Ecuador and the funding of a right-wing paramilitary group in Colombia. Both of these predicaments are equally appalling acts that contain a number of loopholes that release Chiquita from guilt. Chiquita is a leading global produce company involved in the banana trade. Our company is headquartered in Charlotte, North Carolina, but Chiquita Banana and our subsidiaries employ over 20,000 people located in over six continents. Although our company is now dedicated to our core values of Integrity, Respect, Opportunity and Responsibility, over the many years we have been in operation, like any other organization, we have been forced to deal with multiple ethical dilemmas in a business environment. These have even resulted in the organization having trouble with the law. Among such issues were the use of child laborers in our methods of production and the possible payment of multiples sums of money to criminal organizations in South American countries for protection. The last issue,

Nutrition and Vegetables Essay Example for Free
Nutrition and Vegetables Essay Vegetables are a very important part of our diet. Vegetables are an excellent source for fiber, vitamins A and C, potassium, calcium, and iron. Researchers have discovered that having a good diet of fruits and vegetables can lower blood pressure, reduces the risk of heart disease, stroke and possibly some types of cancers. It can also lower your risk of eye problems and digestive problems. Vegetables are eaten in a variety of ways such as main meals or for snacks. The nutritional content in vegetables can vary considerably. Most vegetables do not contain protein or fat. The dried beans, peas, and lentils are a good source of complex carbohydrates and can have high protein content. Sometimes these types of vegetables can be used to some extent as a meat substitute. Potatoes and corn are very starchy vegetables. These types of vegetables turn into sugar. Vegetables have a variety of colors. They can range from dark green to a beautiful orange color. The dark green vegetables are usually the leafy vegetables, and squash, pumpkin, and sweet potatoes are examples of the orange family. Some vegetables have a red/blue coloring such as eggplant and red cabbage. Many articles today have different ideas on the amount or servings of vegetables a person should eat per day. The amounts can range from two (2) up to nine (9) servings per day. The majority of nutrition specialists suggest 2-1/2 cups per day. Potatoes do not count in your servings per day! The best bet for servings are the dark leafy greens, tomatoes, and anything that is yellow, orange, or red color. According to the National Cancer Institute, not enough fruits and vegetables are produced or imported to supply all of the people in the United States for a healthy diet of five servings per person per day. Another problem affecting vegetable growth is bugs and insects. Scientific studies have been conducted that support the claim that insects attack plants that do not receive the proper balance of nutrients. The number of documented outbreaks of human infections associated with raw vegetables and unpasteurized fruit juices has increased in recent years. Most of the outbreaks were identified primarily as Salmonella. Tomatoes, seed sprouts, cantaloupe, apple juice and orange juice are the most recent vegetables to be linked to the Salmonella bacteria. The E. coli infection has been found in lettuce, sprouts, and apple juice. It is very hard to determine the source of contamination for the bacteria for vegetables. Unlike beef and chicken that are thoroughly inspected, methods for fresh produce are not as advanced. The contamination could occur at any point throughout the production process. Some of the potential sources of contamination include soil, feces, irrigation water, dust, insects, and human handling. Recently the Center for Disease Control has had a nationwide recall on alfalfa sprouts with the Salmonella bacteria and for romaine lettuce containing the E. coli bacteria. In conclusion, people have been consuming meats and vegetables since the beginning of time. I am sure many people died back in the beginning of time from the diseases and bacteria we have discovered today. We must consume meats and vegetables to survive. Humans cannot live on water alone. If individuals today will use common knowledge on preparing meats and vegetables, a lot of issues such as the contamination and bacteria would not exist. All in all the meats and vegetables today are safe and nutritious. If consumed in the right amounts, we will have a healthy, long, enjoyable life.
